环境保护是否可以作为终止双边条约的理由——从乌拉圭“纸浆厂”案引发的思考

Abstract

论文从乌拉圭河“纸浆厂”案引发了一个思考，环境保护是否可以作为终止双边条约的理由？论文结合过 往案例考察了《维也纳条约法公约》中对终止条约理由的具体规定，以及国际习惯的理论，并从两个角度论证问题： 环境保护能否转化为《维也纳条约法公约》中规定的终止双边条约的理由？环境保护能否作为一项国际习惯以作为 终止双边条约的理由？最后论文给出结论，可以从《维也纳条约法公约》第 60 条规定的重大违约入手，如果他国违 反了实质义务，则环境保护可以成为终止双边条约的理由。而环境保护不是一项国际习惯，因此不能作为终止双边 条约的理由。
